Cruz, in a detailed social media post, outlined a trio of potential criminal charges including federal marriage fraud—a felony carrying up to five years imprisonment and a $250,000 fine—Minnesota state incest statutes, and tax fraud. His remarks came directly after former President Donald Trump reignited the unproven claim at a Pennsylvania rally, asking the crowd, “She married her brother to get in, right?” and declaring she should “get the hell out” if the allegation is substantiated.

The explosive charges center on Omar’s 2009 legal marriage to Ahmed Nur Said Elmi, which she has repeatedly denied was to a sibling, stating they divorced in 2017. Cruz, however, contends that if proven, the scenario would constitute a clear violation of immigration law intended to “evade…provisions of immigration law,” triggering potential deportation proceedings regardless of her current elected office.
